What is a Legal Opinion ?

A Legal Opinion is a popular form of e-Court dispute resolution. Basically it is an online assessment, advice. Unlike e-Court Arbitration, our Legal Opinion does not issue a binding decision. Instead, the Judge merely offers his/her opinion. The party who starts the Legal Opinion process is known as the Applicant. The other party(s) can/cannot participate and is known as the Respondent(s). The Respondent(s) then explains why they don’t owe the Applicant any money/satisfaction or why the Applicant owes them money/satisfaction. A neutral third party called the Judge ultimately offers his/her opinion/decision.


When people want to know how to handle a sticky situation or otherwise just want to know what e-Courts legal opinion is on a specific matter, then it is time and useful to seek e-Court for assistance. It is important to note that participating professionals whilst not being employees of e-Court have been thoroughly vetted prior to them offering their services.


e-Court aims to offer a venue where members are linked to independent "participating" professionals who can provide competent, affordable, secure, transparent and speedy justice. These professionals whilst not being employees of e-Court have been thoroughly vetted prior to offering their services. It is important to note that legal advice can only be provided by members of their respective provincial law society. For example a Manitoba legal professional selected from the e-Court roster is not permitted to offer legal advice to a e-Court member with residence in Ontario with respect to Ontario law, but he/she is permitted to offer non-legal opinions and business advice to all other provinces and beyond, other than the province of Manitoba. Of course none of foregoing restrictions pertain to mediation & arbitration services offered by e-Court. These fields are not controlled by any provincial law society.


e-Court's Legal Opinion services provide:


Litigation Assessment. This means independant "participating" professionals investigate, assess and explain - in detail - the merits of the litigation case to the parties involved and advises what remedial options they have for handling it. It includes discussion between the parties to be sure that the parties understand our assessment. However, no mediation between the conflicting parties will take place. Our litigation assessment ensures that any decisions e-Court makes in the conduct of the case are made on an informed basis. If services from independant "participating" professionals are used it's their responsibility to understand the case fully and to advise the parties competently, and they take that responsibility seriously.


A typical litigation assessment includes:
(1) online discussion and document review to determine/explain the key factual, legal and procedural issues
(2) discussion and identification of available evidence for and against
(3) identification of available procedures by which remedies may be sought
(4) explanation of any impending limitation period issues
(5) explanation of any major expenses involved in pursuing the matter, such as expert report fees, court fees, etc
(6) e-Court opinion on the merits of the case, and recommendations on how to proceed
(7) consideration of settlement oppourtunities at all stage of the case
(8) writing of e-Court's legal opion to be sent to the parties
(9) an online conference call ( Skype ) may take place


Main differences between e-Court LEGAL-OPINION & ARBITRATION :
(1) Legal opinion does not offer a binding decision, merely an opinion
(2) With Legal Opinion it is possible for just one party to be involved ( one who just wants to know what independant "participating" professionals legal opinion is on a specific matter )
(3) there is no appeal process possible
(4) there is no monetary escrow since are no money transfers
(5) fees associated with issuance of a legal opinion are less


The key to knowing whether a legal opinion may work for the parties is knowing whether the disputed parties will compromise on the basis of an opinion by a legal Professional. Remember, the judge doesn't mediate between the parties or decide issues and doesn't make binding rulings. If all fails independant "participating" professionals legal opinion can be used in a traditional government court. Don't forget, you will in that case also have to pay for new lawyers and the government court system. The longer the dispute takes to settle, the more you'll have to pay, that is if you seek judgement outside the e-Court online system.
